PRIVACY POLICY

In compliance with Regulation (EU) 2016/679 of the European Parliament and Council, of April 27, 2016, regarding the protection of individuals concerning the processing of personal data, repealing Directive 95/46/EC (hereinafter GDPR), Law 34/2002, of July 11, on Information Society Services and Electronic Commerce (hereinafter LSSI-CE), and Organic Law 3/2018, of December 5, on the Protection of Personal Data and the guarantee of digital rights, Artlote guarantees the protection and confidentiality of the personal data provided by our users, in accordance with the provisions of the General Data Protection Regulation (GDPR)

  1. Purpose and legal basis for processing: The data provided freely and voluntarily by registered users through the forms enabled for this purpose on the website are collected by Artlote for the purpose of facilitating the provision of the service, specifically access via username and password.

2. Retention period: Your data will be kept as long as there is a mutual interest in maintaining the contractual relationship, or until you exercise your right to erasure, objection, or restriction of processing. We only retain your Personal Data for as long as we need it for the purpose for which we process it, to meet your needs, to execute the contractual relationship established between you and Artlote, or to comply with our legal obligations.

In this regard, Artlote will retain your personal data, duly blocked, after the termination of your relationship with us, for the duration of the statute of limitations for any legal actions that may arise from that relationship.

Once blocked, your data will be inaccessible to Artlote and will not be processed except to make it available to public authorities, judges, and courts to address any potential liabilities arising from the processing, as well as for the exercise and defense of claims before the Spanish Data Protection Agency.

3. Data Destination: Your data will not be shared or transferred to third parties, except where there is a legal obligation to do so.

4. User Rights: We inform you that you may exercise the following rights:

a) Right of access to your personal data, to know which data is being processed and the processing operations carried out with it;

b) Right to rectification of any inaccurate personal data;

c) Right to erasure of your personal data, when this is possible (for example, due to a legal obligation);

d) Right to restriction of processing of your personal data when the accuracy, lawfulness, or necessity of the data processing is in doubt, in which case we may retain them for the establishment, exercise, or defense of legal claims;

e) Right to object to the processing of your personal data when the legal basis that allows us to process it is our legitimate interest. Artlote will cease processing your data unless it has a legitimate interest or it is necessary for the defense of legal claims, where this right applies.

g) In order to guarantee the exercise of the rights expressed in the previous paragraph, Artlote undertakes to rectify or, where appropriate, to delete all private data of the cancelled user, within a maximum period of 10 days from receipt of the cancellation request.

h) Right to withdraw the consent given to Artlote.

7. Security: We employ all reasonable efforts to maintain the confidentiality of personal information processed on our systems. We maintain strict security measures to protect the personal data we process against accidental loss and unauthorized access, processing, or disclosure, taking into account the state of the art, the nature of the data, and the risks to which it is exposed. However, we cannot be held responsible for your use of the data (including username and password) you use on our website. Our staff adhere to strict privacy policies, and if we contract with third parties to provide support services, we require them to comply with the same policies and allow us to audit them to verify their compliance.

8. Minors: Artlote’s services are intended for adults. If we suspect or become aware at any time that a minor has registered, we will cancel the registration and prevent that person from accessing or using the corresponding products, services, or content.

9. Updates: Artlote reserves the right to modify this policy to adapt it to new legislation or case law that may affect compliance with it.
